This page explains major concerns that arise from the dispute. Each issue is described based on my records, documents, and opinions.

  • Payment Handling: Based on my records, payments were tendered and receipts were issued. The later treatment of those payments is disputed. In my opinion, the available documents raise questions about whether the bank clearly explained how the payments were processed, reversed, rejected, or applied.
  • Communication and Documentation: A central concern is whether the bank provided clear written explanations, complete account ledgers, and consistent servicing information. In my opinion, unclear communication made resolution harder and increased the risk of unnecessary legal escalation.
  • Collection Activity: My position is that collection activity continued while important account history and payment application issues remained disputed. This raises concern about whether the matter was handled with sufficient care before aggressive remedies were pursued.
  • Cognovit Judgment: The court record involves cognovit judgment issues. My position is that the judgment should be reviewed in light of the disputed servicing history, payment records, communications, and related exhibits.
  • Borrower Impact: The disputed conduct affected real estate operations, cash flow, business planning, legal expenses, and borrower confidence. In my opinion, this matter shows why borrowers should insist on complete written records, payment receipts, ledgers, and documented servicing communications.
